Description: I need a licensed New Mexico attorney for a limited scope engagement — one task, not my whole case.
The task: Determine whether a notarized statement from a qualified health care professional about my husband's incapacity exists.
Background: The power of attorney his sister used to take control of him and his care at the Albuquerque VA hospital says it "shall become effective only if I become incapacitated," and required a notarized statement of incapacity before she could act. The power of attorney was used in October–November 2025. I do not know if that statement exists.
What I need:
• A records request to the New Mexico VA Health Care System, 1501 San Pedro Dr. SE, Albuquerque, NM 87108, for any notarized incapacity statement and the authorization documents from on or about November 17, 2025
• Follow-up with their Release of Information office and Privacy Officer
• If refused, advice on next steps
Context: A forensic examiner has opined the power of attorney is invalid and the signatures are not my husband's among other things.
Please answer:
1. Are you licensed in New Mexico?
2. Your New Mexico bar number.
3. Your hourly rate and estimated hours.
Documents I will provide: the power of attorney and the examiner's report.
Preferred: New Mexico bar admission; elder law or probate experience.
