We are a US-registered e-commerce company seeking an attorney admitted and in
good standing in the State of New York to defend a low-value consumer claim
filed in the Civil Court of the City of New York, Kings County.
BACKGROUND
A consumer has filed a Summons with Endorsed Complaint seeking under $5,000,
based on alleged non-delivery, defective merchandise and refund issues arising
from a single 2026 transaction. The matter is in the general Civil Part, not the
Small Claims Part, so under CPLR 321(a) our company must appear through counsel.
Service was effected on our registered agent outside New York City.
SCOPE OF WORK
1. Confirm the answer deadline by checking the court file for the date the
affidavit of service was filed.
2. Prepare, file and serve a timely Answer with appropriate defenses, so that
no default is entered.
3. File a notice of appearance on the company's behalf.
4. Review the correct legal name of the defendant entity and advise whether a
misnomer or jurisdictional defense is available.
5. Advise on and, if instructed, negotiate a settlement and stipulation of
discontinuance with the plaintiff.
6. Appear at conferences or hearings as required.
WHAT WE WILL PROVIDE
Order records, customer-service correspondence, refund and shipping evidence,
and our published terms of sale. Our existing outside corporate counsel (admitted
in other states) will prepare background materials to keep your hours low. You
would act as counsel of record in New York.
REQUIREMENTS
- Admitted to practice in New York State and in good standing
- Prior experience in NYC Civil Court consumer or commercial matters
- Active professional liability insurance
- Able to act within the next several days, as the answer deadline is near
TO BID, PLEASE INCLUDE
- Your New York bar admission year and attorney registration status
- A short description of two similar NYC Civil Court matters you have handled
- Your hourly rate, and whether you would offer a flat fee for steps 1-3
- Your estimated hours to reach a filed Answer
- Your availability this week
We will share the case documents privately with shortlisted bidders after an
engagement letter and conflicts check are in place. Please keep all
communication on Freelancer until an engagement is agreed.
